Privacy, Terms & Notices
Emkat Inc. (doing business as Emkat Staffing and Recruiting) · 337 Westford Street, Lowell, MA 01851
Effective date: October 24, 2026
1. Information we collect
Information you give us
- Account: name, email and/or mobile phone, and a password. Passwords are stored in encrypted (hashed) form, and Emkat staff cannot see them.
- Profile: city, state, ZIP, preferred language, shifts, work interests, skills, certifications, transportation, availability, whether you are authorized to work in the U.S., and any notes you add.
- Documents: resumes, certificates and reference letters you upload, and resumes you build in the app.
- Applications: the jobs you apply to, "Other position" requests, and their status.
- Messages: questions you send to the 24/7 assistant and its answers.
- Employer requests: company and contact details that businesses send us.
Information collected automatically
- Basic technical data needed to run and secure the app, such as IP address (used to block abuse and repeated login attempts), browser type, and the date and time of requests.
Please do not upload Social Security cards or numbers, bank or card details, immigration documents or medical records through the app. We collect new-hire paperwork separately and securely during onboarding.
2. How we use it
- To review your application, match you with jobs, and contact you by phone, text or email about openings and your applications.
- To onboard you if you are hired, and to communicate about your assignment.
- To answer your questions, including through the AI assistant.
- To keep the app secure, prevent fraud and abuse, and fix problems.
- To meet our legal obligations, such as employment record-keeping and responding to lawful requests.
3. When we share it
- Client companies: when we present you for a specific job, we share the information needed for that job, such as your name, relevant experience, skills and resume. We do not give client companies access to your account.
- Service providers that run the app for us and may only use your information to provide their service: website hosting (GoDaddy), email delivery (such as Resend), AI processing (Anthropic) and, if text messaging is turned on, text delivery (such as Twilio).
- Legal reasons: when required by law, subpoena or court order, or to protect the rights, safety and property of people or Emkat.
- Business transfer: if Emkat is merged or sold, your information may transfer to the new owner under this policy.
We do not sell your personal information. We do not share your mobile number or text-message consent with any third party for their marketing.
4. AI features
The 24/7 chat assistant and the resume writer use artificial intelligence (Claude, made by Anthropic). The assistant is a computer program, not a person. It can make mistakes, so please confirm important details with a recruiter. AI is used to help candidates and recruiters. Hiring decisions are made by people at Emkat and its clients, not by AI alone. Chats may be reviewed by Emkat staff to help you and to improve our service.
5. Text messages (SMS terms)
- Program: Emkat Jobs alerts. If you opt in, Emkat may text you about job openings that match your profile and updates on your applications. One-time sign-in or password codes may also be sent by text.
- Frequency: message frequency varies. Message and data rates may apply.
- Opt out: reply STOP at any time to stop texts. Reply HELP for help, or call 978-421-6952.
- Consent is optional: agreeing to texts is not a condition of applying, being hired or being placed.
- Mobile carriers are not responsible for delayed or undelivered messages.
6. Cookies and storage
We use one essential cookie to keep you signed in. The app also saves your unfinished resume draft in your own browser so you don't lose it. We do not use advertising cookies or sell browsing data. If you block cookies, you will not be able to stay signed in.
7. How we protect it
- All connections use encryption (https).
- Passwords are hashed. Sign-up and reset codes expire after 15 minutes and lock after repeated wrong tries.
- Documents are stored in a protected area that only you and authorized Emkat staff can open.
- Staff access is limited to people who need it, and is removed when they leave.
- Repeated sign-in attempts are blocked to stop automated attacks.
No system is perfectly secure. If a security breach affects your personal information, we will notify you and the authorities as required by Massachusetts and New Hampshire law.
8. How long we keep it
- Active profiles are kept while you use your account. Profiles inactive for 3 years may be deleted.
- Application records: employment laws require us to keep a basic record of applications (name, contact information, jobs applied for and dates) for a limited time, generally at least 1 year after the application or hiring decision. We keep that minimum even if you delete your profile.
- Employees: payroll, tax and personnel records for people who work Emkat assignments are kept for the periods the law requires.
- Chat logs are kept up to 2 years.
9. Your choices
- See and update your information anytime in My Profile.
- Delete your documents and profile details with My Profile → Delete my profile and documents, or by emailing info@em-kat.com.
- Get a copy of the information we hold about you, or ask us to correct it, by emailing info@em-kat.com. Massachusetts employees and former employees may also request their personnel record.
- Stop texts by replying STOP, and turn off job texts in your profile.
We respond to requests within 30 days. We may need to verify your identity first.
10. Age requirement
You must be at least 18 years old to create an account. The app is not intended for children, and we do not knowingly collect information from anyone under 18. If you believe a minor has created an account, contact us and we will delete it.
11. Hiring notices
Equal opportunity
Emkat Inc. is an equal opportunity employer. All qualified applicants receive consideration for employment without regard to race, color, religion, creed, sex, pregnancy, sexual orientation, gender identity, national origin, ancestry, age, disability, genetic information, military or veteran status, or any other status protected by federal, Massachusetts or New Hampshire law.
Reasonable accommodation
If you need an accommodation to apply because of a disability or for religious reasons, call 978-421-6952 or email info@em-kat.com and we will help you apply another way.
Massachusetts lie detector notice
It is unlawful in Massachusetts to require or administer a lie detector test as a condition of employment or continued employment. An employer who violates this law shall be subject to criminal penalties and civil liability.
What we don't ask
Our application does not ask about your salary history or about criminal records. If a background check is required for a specific job, we will tell you and ask for your written permission first, as the law requires.
Pay ranges
Where required by Massachusetts law, job postings include a good-faith pay range. Final pay depends on the client company, the shift and your experience, and your recruiter confirms it before you start. You may ask your recruiter for the pay range of any job you are offered or currently hold.
At-will employment, no guarantee
Applying or creating a profile does not guarantee a job or an interview. Nothing in this app creates a contract of employment. Employment with Emkat is at-will, unless a written agreement signed by Emkat's President says otherwise.
12. E-Verify
Emkat Inc. participates in E-Verify. After you accept a job offer and complete Form I-9, we use E-Verify to confirm your eligibility to work in the United States. We do not use E-Verify to pre-screen applicants. You have the right to work and to be free from discrimination based on citizenship status or national origin. The official E-Verify Participation and Right to Work posters are available at e-verify.gov, and in our office.
13. Terms of use
By using Emkat Jobs you agree to these terms.
- Eligibility and honesty: you must be 18 or older and give true, accurate information. Create an account only for yourself.
- Your account: keep your password and codes private. Emkat will never ask for your password or a verification code by phone, text or chat. Tell us right away if you think someone used your account.
- Your content: you keep ownership of the resumes and documents you upload. You allow Emkat to store, use and share them with client companies to help you find work, as described in this policy.
- Acceptable use: don't upload anything false, illegal, harmful or belonging to someone else. Don't try to break, overload or get around the app's security, and don't use bots to collect data from it. We may suspend accounts that misuse the app.
- Job information: postings describe typical duties and may change. Location, schedule and pay are confirmed by your recruiter. Jobs may be filled or closed at any time.
- AI and tools: AI answers and AI-written resumes may contain mistakes. Check your resume before you use it.
- Availability: we work to keep the app running, but it is provided "as is" and may sometimes be unavailable. To the fullest extent the law allows, Emkat is not liable for indirect or consequential damages from using the app. This does not limit any rights you have under employment or consumer protection laws.
- Governing law: these terms are governed by the laws of the Commonwealth of Massachusetts.
- Changes: we may update this page. We will change the effective date at the top, and tell signed-in users about important changes.
